If It Endangers the State, Public Information is Prohibited from Being Informed

Pustiknas, UIN News Online – Commissioner of the Public Information Commission (KIP) Agus Wijayanto Nugroho stated, in addition to information that is allowed to be shared with the public, there is also information that is prohibited to be shared, such as information that can harm the state or relate to a person's personal rights.

“Examples of public information that are prohibited from being shared are information on strategy, intelligence, operations, tactics and techniques related to the implementation of the state defense and security system, including the planning, implementation, and termination stages or evaluation in relation to threats from within and outside the country,” said Agus in front of the Legal Counseling participants at the National Information and Communication Technology Center Building (Pustiknas), Wednesday (03/23/2022).

The Legal Counseling, organized by the Center for Public Relations and Legal Aid Service (PLHBH) of UIN Jakarta, among others, discussed the Information Commission (Perki) Regulation Number 1 of 2021 concerning on Public Information Service Standards. Also present in the event, Rector of UIN Jakarta Amany Lubis, Head of Planning and Finance Bureau Rojikin, and Head of PLHBH Afwan Faizin.

Agus also added that other information that is excluded according to Perki is information relating to the interests of protecting business from unfair business competition and information that has not been controlled or documented.

“Public information that is excluded under the provisions and laws and regulations is also included in this category,” he added.

Agus further said that Perki also regulates how BP through the Information Management and Documentation Officer (PPID) provides information services that are excluded. It is contained in the Consequence Test, especially with regard to the Procedure for Submission of Exempted Information.

Among other things, PPID is prohibited from opening and providing copies to the public and PPID is obliged to obscure information material that is excluded from copies of public information documentation that will be provided to the public.

In addition, PPID is prohibited from using partial exclusion of information in a copy of a public information document as a reason to exclude public access to the entire copy of a public information document.

“PPID is also required to maintain confidentiality, manage, and store the previously excluded public information documents,” he said.

Meanwhile, in determining the time period for the exempted information, according to Agus, the duration is no later than 30 days before the expiration of the exemption period. (ns/usa)
